European Electronic Communications Code (EECC) Notice

The EECC requires us to provide this information to applicable users of Zoom Phone, Zoom Meetings, and Zoom Team Chat services. This information supplements the Zoom Terms of Service available on Zoom’s website at https://www.zoom.com/.

Upon request, we will make available this EECC Notice in an accessible format.

Quality of Service: As detailed in our applicable terms, we cannot guarantee any
minimum levels of quality of service and make no guarantees that the Zoom Phone, Zoom Meetings, or Zoom Team Chat services will always function without disruptions, delay, or errors. A number of factors beyond our control may also impact your user experience and may result in the disruption of your communication with other users including but not limited to: your local network, firewall, your internet service provider, the public internet, and power supply.

Standard contract conditions: Charges: details of any Charges applicable to your use of Zoom Phone, Zoom Meetings, or Zoom Team Chat services will be set out in your Order Form, including details of any Taxes or Fees applicable to your use of any of these Zoom services.

Standard contract conditions: Duration, Renewal, and Termination

    • Your Order Form will specify your Initial Subscription Term and any applicable Renewal Terms. 
    • Each Renewal Term will renew automatically unless you provide notice to terminate, in accordance with clause 14.1 of the Zoom Terms of Service. 
    • You can otherwise cancel your Agreement in accordance with clause 14 of the Zoom Terms of Service. 
    • We are entitled to terminate or suspend your contract with us if you fail to comply with any provision of the Zoom Terms of Service or any policies, guides, notices, or statements referenced therein.

For the avoidance of doubt, Zoom Meetings and Zoom Team Chat services do not support access to emergency services.

Dispute resolution mechanisms: if you have a complaint about the Zoom Phone, Zoom Meetings, or Zoom Team Chat services, you can raise it by contacting our customer services team using the details set out above. You may also be entitled to refer disputes in relation to matters covered by the EECC to an independent body for dispute resolution appointed in your country. Notification of EECC Special Terms and EECC Waiver that Apply in the EEA/UK

These EECC Special Terms and EECC Waiver apply to your use of the Zoom Phone, Zoom Meetings, and Zoom Team Chat services in the EEA/UK and supplement the Zoom Terms of Service (available at: https://explore.zoom.us/en/terms/), in accordance with the European Electronic Communications Code (as established by Directive (EU) 2018/1972 of the European Parliament and of the Council of 11 December 2018) (the “EECC”).

Upon request, we will make available these EECC Special Terms and EECC Waiver in an accessible format.

 

EECC Special Terms


Amended 15.1 General Changes. Zoom may make modifications, deletions, and additions to this Agreement (including to its guides, statements, policies, and notices, with or without notice to you, and for similar guides, statements, policies, and notices applicable to your use of the Services) (“Changes”) from time to time in accordance with this Section 15.1 and Section 15.2 below. If Zoom introduces any Changes and you do not terminate the Agreement in accordance with Section 15.3 and continue to use the Services after the effective date of the Changes, then you agree to the revised terms and conditions.


15.2 of the Zoom Terms of Service is deleted in its entirety.


Amended 15.3 Change Notifications. It is your responsibility to keep your email address up to date for any notices that Zoom may send to you from time to time. If Zoom plans to make any Changes, it shall provide You with thirty (30) days’ advance notice of any Changes. If you do not agree to such Changes, You may be entitled to terminate the Agreement, without incurring any further costs, by providing Zoom with thirty (30) days’ written notice of termination, unless the Changes: (i) exclusively benefit You as the Customer; (ii) are of a purely administrative nature; (iii) have no negative effect on You as the Customer; and (iv) as otherwise directly imposed by law.


Amended 14.1 Effect of termination or Suspension. Upon any termination of this Agreement, you must cease any further use of the Services and Software, except for any access rights granted in Section 14.5. No expiration or termination of this Agreement will affect your obligation to pay all Charges that may have become due before such expiration or termination, including that Zoom may retain any Charges previously paid by you if this Agreement is terminated, save that if You terminate this Agreement in accordance with Section 14.2 (termination for cause), Zoom will refund to You any prepaid fees covering the remainder of the Subscription Term or Renewal Term (as applicable) of all Order Forms after the effective date of termination. If your Services are suspended for your failure to comply with this Agreement, you will be liable for all Charges due and owing during the period of suspension.

 

EECC Waiver (optional)


If you are a microenterprise, small enterprise, or a not-for-profit organisation (defined
below) and Zoom (“we”) provides you with an interpersonal communications service
within the European Economic Area or the United Kingdom, please read the EECC Waiver
(defined and set out below).


To the extent that (i) Zoom Phone, Zoom Meetings, and Zoom Team Chat services are
interpersonal communications services under the EECC, (ii) you are a micro-enterprise,
small enterprise, or not-for-profit organisation and (iii) we provide you with any of such
services within the European Economic Area (“EEA”) or the United Kingdom, you may
agree to waive any rights (to the extent applicable) that you may have under:


(i) Article 102(1), (2) and Annex VIII of the EECC, which would allow you to receive
certain pre-contractual information;
(ii) Article 102(3) and (4) of the EECC, which allows you to receive a contract summary;
(iii) Article 102(5) and (6) of the EECC, which allows you to monitor and control usage of
interpersonal communications services;
(iv) Article 105(1), (2) of the EECC, which limits the maximum contract duration;
(v) Article 106(9) of the EECC, regarding number portability;
(vi) Article 107(1) of the EECC, which extends other rights in the EECC to all services
provided to you; and
(vii) Article 107(3) of the EECC, which relates to contract extensions,
(collectively, the “EECC Waiver”).

Definitions. Micro and small enterprises and not-for-profit customers are defined in national law. Typically:

•Micro-enterprise: Headcount <10; Turnover ≤ € 2 m
• Small enterprise: Headcount: <50; Turnover ≤ € 10 m.
• Not-for-profit: not specifically defined in the EECC, but are legal entities that do not earn a profit for their owners or members. Typically, not-for-profit organisations are charities or other types of public interest organisations.

Hungary


Zoom Phone: Zoom is not responsible for terminating Zoom Phone calls. Zoom relies on third-party network providers to do so.
